Following calls for a strengthening of pool safety requirements the NSW Government has introduced amendments to the Swimming Pools Act 1992. The Swimming Pools Amendment Act 2012 commenced on 29 October 2012. Some of the changes under the new law are:
- Pool owners will be required to register their pool on a State-wide online register.
- Pool owners wanting to sell or lease a property with a pool will be required to attach a valid swimming pool compliance certificate to the contract.
- Swimming pool requirements will apply to a wider range of commercial and shared residential accommodation.
- Councils will be required to develop swimming pool inspection programs.
If you have a swimming pool and you are not sure of your obligations you are strongly recommended to seek legal advice.
